Wedding Photography Agreement |
The agreement contains the entire understanding between Melissa Furina (referred to from this point on as “Still Parade Photographics” or “THE PHOTOGRAPHER”) and the “CLIENT”. The only way to add or change this agreement is to do so in writing, signed by all the parties.
It is agreed that Still Parade Photographics will supply photographic services on the agreed date, subject to external variables beyond her control (e.g. weather, location/venue restrictions, light availability, scheduling complications due to lateness/willingness of individuals). • Pre-wedding Consultation The parties agree to a pre‑event consultation either in person, phone or email, preferably three (3) to four (4) weeks before the event date. • Copyright Under Australian Copyright Law, the CLIENT holds the copyright to my wedding photos as the commissioning CLIENT for the resultant creative work. However, the CLIENT agrees to transfer copyright ownership over to Still Parade Photographics in exchange for ownership of the digital files and a non-expiring personal license to print, duplicate, and share our wedding photos. Permission is not given for the CLIENT to sell images. Still Parade Photographics is not required to submit all unedited images from the day. Still Parade Photographics will supply images that meet her artistic and technical standards. • Model Release The CLIENT gives their permission for Still Parade Photographics to use any photograph taken by her or any of her sub‑contracted photographer/s in photographic competitions, wedding exhibitions, editorial, website, business Facebook and Instagram, advertising or any other purpose. • House Rules It is understood that Still Parade Photographics and any of her sub-contracted photographers will require breaks from time to time. THE PHOTOGRAPHER/S will take a break during dinner and dessert service and occasionally throughout the day. If the PHOTOGRAPHER/S are required to remain after the guests are seated at the reception, a meal must be provided. Still Parade Photographics is limited by venue management and other suppliers. Negotiation with the suppliers is the CLIENTS’ responsibility. The CLIENT agrees to accept the technical results of their choices (for instance lighting, colour, props, location, etc). It is also understood that no other photographer, amateur or professional, shall be allowed to photograph at formal locations while Still Parade Photographics or any of her sub‑contracted photographer/s are working. Still Parade Photographics is not obliged to take photos of persons including vendors, guests, and those unrelated to the event of the wedding for their own personal gain. • Limit of Liability In the unlikely event that THE PHOTOGRAPHER is injured or becomes too ill to photograph the event, or if THE PHOTOGRAPHER is unable to perform to the guidelines of this contract due to causes beyond the control of the parties involved, THE PHOTOGRAPHER will make every effort to secure a replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received by Still Parade Photographics. Still Parade Photographics takes the utmost care with respect to exposure, transportation, and processing the photographs or footage. However, in the unlikely event that photographs or footage has been lost, stolen, or destroyed for reasons within or beyond Still Parade Photographic’s control, Still Parade Photographic’s liability is limited to the return of all payments received for the event package. The limit of liability for a partial loss of images shall be a prorated amount of the expenses lost based on the percentage of total number of photographs or footage. THE PHOTOGRAPHER will not be responsible for any missed moments. The CLIENT may present with a list of suggested photographs in writing, but is unable to guarantee that those suggested photos, or any image, will be captured. • Harassment It is understood that in the event that Still Parade Photographics experiences any inappropriate, threatening, hostile or offensive behaviors from any guest or person at the wedding (including, but not limited to, unwelcome sexual advances and verbal or physical conduct of a sexual nature), THE PHOTOGRAPHER may request the offending person(s) to be removed from the premises immediately or leave the event completely. • Security Deposits Upon signature and received deposit, Still Parade Photgraphics reserves the wedding date and time agreed upon in this contract. For this reason, all deposits are non‑refundable, even if the wedding date is changed or cancelled for any reason. The CLIENT shall also be responsible for payment for any of Still Parade Photographic’s charges and expenses incurred up to the time of cancellation. • Completion Schedule Image processing to proof stage takes approximately four (4) to six (6) weeks. Album generation takes approximately four (4) to six (6) weeks from the date when the CLIENT proofs the images. I have read, understood and agree to the realms and conditions of the Agreement. |
